First Appearance
At a first appearance a plea of guilty or not guilty needs to be entered. Often, however, at this first stage, police disclosure has not yet been provided to the Defence. If this is the case, your case will be adjourned until you and your lawyer have had time to review the evidence and formulate a plan of attack. Once you have decided how to tackle the case a plea is entered. Remember, you are innocent until proven otherwise. The prosecution has to present enough evidence to convict, never the other way around!
Trial
The trial requires detailed preparation. Your lawyer must know the facts inside and out and understand how the law operates within the framework of those facts. Hinton Criminal Lawyer Ziv makes sure the law and facts are properly researched and understood.
Your Defence
The defendant has the opportunity to cross-examine the Crown’s witnesses as well as have the opportunity to call out any insufficient evidence, call its own evidence if necessary, and submit closing argument.
If the judge or jury has a doubt, a conviction cannot be entered. Not guilty must be the verdict.
