Murder Charges

Murder is the most serious criminal offence in Canada. If you believe you are at risk of being charged with murder, it is extremely important to contact experienced defence counsel right away. The Criminal Code of Canada encapsulates many actions which may constitute murder. Including causing the death of another person while:

  • Meaning to cause their death; or
  • Meaning to cause bodily harm knowing it is likely to cause their death, or is reckless

Murder in Canada is divided into two separate offences; first degree and second degree murder.

First Degree Murder

First degree murder includes acts that:

  • are planned and deliberate; or
  • include contract murder (i.e. hiring a “hitman”); or
  • involve a victim who is a peace officer, prison employee or person working within a prison; or
  • involve hijacking, sexual assault, kidnapping and forcible confinement or hostage taking, criminal harassment, intimidation, or terrorist activity; or
  • involve organized crime

Second Degree Murder

Second degree murder encapsulates any murder which does not fall into the requirements of first degree murder.

When You Are First Charged

Given the seriousness of the offence, if you have been charged with murder, you will be held in custody upon arrest. While you will be entitled to a Bail Hearing, there are many obstacles to release. Sentencing

Both first and second degree murder attract the same punishment: life imprisonment. A murder conviction does not necessarily mean a life in prison, however.

If you are convicted of first degree murder you become eligible for parole after 25 years. A conviction for second degree murder will attract a parole eligibility date within a range of 10 to 25 years, which is determined by the sentencing justice.
